See Ch.114 for further information about water. Zoning — See Ch.120 for further information. Subdivision restrictions can be found in Chapter A122. The aim of this chapter is to govern the placement, installation, construction, maintenance, and usage of individual sewage systems in the Village of Greenwood Lake, County of Orange, and State of New York, as well as the operation of such systems.

According to their definitions in this chapter, the following words must have the following meanings: INSPECTOR OF BUILDINGS The legally designated Building Inspector or Assistant Building Inspector appointed by the Greenwood Lake Village Board, who shall have the authority to review any plans and/or refer them to the Village Engineer, Public Health Officer, and/or the County or State Department of Health for additional review.

DEVELOPMENT OF A UNIFORM PERSONAL WASTE DISPOSAL SYSTEM A sewage disposal system that receives either human excreta or liquid waste, or both, from an individually owned residence or place of business, and which includes and applies to all portions of said system that are located outside of the foundation walls of any building, shall be defined as follows: Septic tank soil-absorption systems, privies, chemical-type toilets, and any other forms of toilets that may be mandated in this chapter or by county and/or state department of health rules are included within the scope of this term.

PERSON The term “institution” includes any public or private corporation, person, partnership, organization, or other legal entity.PUBLIC HEALTH OFFICERT The Village Board of Greenwood Lake shall appoint a legally designated Public Health Officer, who shall be a physician licensed to practice medicine in the State of New York, to serve as the village’s public health officer.

  • Wastes from these systems must be disposed of in such a way that:A.Drinking water sources are not jeopardized or contaminated; andB.The environment is not polluted.
  • As a consequence of sewage being exposed on the surface of the ground and being accessible to children, no health danger will be generated.
  • In order for any plan submitted under this rule to be approved, it is mandatory that the relevant approvals from the federal, state, and municipal governments be secured.
  • There will be no disturbance, such as offensive scents or unsightliness, generated by this project.

The owner of any property on which is currently maintained an outside privy and/or privy vault or any outside toilet facility, whether part of a privy and/or privy vault or septic disposal system, shall cease the use of such facilities within a period not exceeding 180 days from the date of adoption of this chapter.

The Building Inspector must authorize the removal and discontinuation of such privy and privy vault, septic tank, and septic system before they can be completed.

This chapter requires that all sewage disposal facilities be connected to a sewage disposal system that is established and maintained in strict compliance with the rules of this chapter.

The construction, alteration, repair, or extension of individual sewage disposal systems within the Village of Greenwood Lake shall be unlawful unless the person conducting the construction, alteration, repair, or extension is in possession of a valid permit* issued by the Building Inspector in such person’s name for the specific construction, repair, alteration, or extension proposed.

If nothing else is specified, a fee, which shall be established from time to time by decision of the Board of Trustees, shall be paid to the Building Inspector at the time of application filing, except as otherwise provided.

*NOTE: This sewage permit as issued by the Building Inspector is in addition to the building permit usually required for building construction and shall be obtained prior to construction, alteration or extension of the residence or facility to be served.

C.Where public or communal sewerage systems are reasonably available, the Building Inspector may refuse to provide a permit for the building of an individual sewage disposal system. The following information must be included in all permission applications: D.Applications for permits must be in written and signed by the applicant. (1)The applicant’s name and address, as well as the lot, block, and section number of the property on which the planned construction, repair, alteration, or expansion is to be carried out.

When judged required, such plan should be created by a professional engineer licensed in the State of New York who is also a registered architect.

It is not permissible in the Village of Greenwood to make repairs, make renovations, or build dry wells in any of its properties.

Building Inspector, Assistant Building Inspector, and/or Public Health Officer from the Village of Greenwood Lake shall have free access to the property at reasonable times during the working day for the purpose of conducting such inspections as may be necessary to determine compliance with the provisions of this chapter and any regulations promulgated thereunder.

If you refuse to allow the Building Inspector, Assistant Building Inspector, and/or Public Health Officer of the Village of Greenwood Lake free access to your property at reasonable times during the working day for the purpose of conducting inspections to determine compliance with the requirements of this chapter and the regulations promulgated thereunder, you will be subject to a civil penalty of up to $1,000.

A person who causes or allows the discharge of sewage or waste, including wastewater from washing machines, showers, tubs, sinks, and car-washing operations, from any house or other structure in the Village of Greenwood Lake into or upon any highway, public ground, private way, ditch, surface ground area (public or private), or into the waters of Greenwood Lake directly or through its tributaries, streams, or brooks or through the drainage system of the Village of Greenwood Lake is subject to a fine of • E.Use in conjunction with any sewage disposal system or chlorination facilities of any sort A sewage disposal system that allows or permits the discharge of roof leaders or footing drains is defined as follows: The discharge of such drainage must be done in a manner that has been approved by the Building Inspector.

The Building Inspector shall issue an order to rectify violations for any and all breaches of this chapter or the rules published thereunder for which remedial action is required.

The violation, as well as the date by which the infraction is to be repaired and alleviated, must be explicitly stated in all orders to rectify violations.

On conviction, any person who violates any provision of this chapter is guilty of a violation of the Penal Law of the State of New York, which is punished by a fine of not more than $250 or by imprisonment for a time not more than 15 days, or by both a fine of $250 and imprisonment.

In the event that any owner, occupant, lessee, or other person in charge of any premises within the Village of Greenwood Lake fails, neglects, or refuses to correct or remove any violation of this chapter within 24 hours after the same has been certified by the Public Health Officer of the Village of Greenwood Lake and the Village Board of Health as posing a serious and imminent threat to the health, safety, or welfare of any of the inhabitants of this Village, then the owner, occupant, lessee, or other person in This remedy shall be in addition to and not in substitution for any other remedy allowed by this chapter.

It shall be the case in any case where a provision of this chapter is found to be in conflict with any provision of any zoning and building code as well as any fire safety and health law, ordinance, or code of the Village of Greenwood Lake that was in effect on the date of the effective date of this chapter that the provision that establishes a higher standard for promoting and protecting the health, safety, and welfare of the people shall prevail.
